tiffany silver "The man looked at his wife and saw that the child was on the way. This made him drive into the median strip and the car flipped over and ended up in a ditch," Pär Törnhult of Gästrike emergency services told local newspaper Gefle Dagbladet, according to Sweden's The Local.
tiffany Fortunately, the vehicle landed upright in the ditch. As nearby motorists stopped to help the crash victims, the woman gave birth on the roadside within the crashed car. By the time one passerby -- who happened to be a fireman -- arrived at the scene, the baby girl was apparently already on the floor of the car.
Emergency services rushed the vehicle's four passengers and newborn to the hospital shortly after the crash. Both the mother and infant are reportedly in stable condition.
The crashed car birth is the latest of several roadside deliveries. Last month, a mother nicknamed her newborn son "superman" after a speedy roadside birth in Livermore, Calif. In June, Lynette Hales gave birth to twins along Interstate 80 in Utah, and even saved one of the infants by performing CPR until state troopers arrived.

The post-master, who put the baby on the scales (and handled her with care?), said she weighed "the equivalent of an £8.22 first class parcel."

In An Art Gallery Performance artist Marni Kotak <a href="http://www./2011/10/26/marni-kotak-performance-a_n_1032365.html" target="_hplink">made headlines</a> earlier this year when she announced her plans to give birth inside a New York art gallery because it is the "highest form of art."
With approximately 20 people in the room, she delivered baby Ajax in late October. Footage of the birth will be added to an upcoming exhibition at the Microscope Gallery in Brooklyn.

Virtual Console review: Kirby’s Dream Land 3

[You must be registered and logged in to see this link.] Een koe kan je melken. Dat is algemeen bekend en er worden de nodige levensmiddelen van zuivel gemaakt. Volle melk, halfvolle melk, karnemelk, melk met fruitsmaakjes, chocolademelk, yoghurt, vla, roomijs, kaas, brie (eigenlijk ook kaas, maar dan Frans), slagroom, pudding, boter, kruidenboter, crème fraîche en zelfs games. Althans, over die laatste twijfel ik nog een beetje. Toch lijkt het er soms op dat games ook gemolken worden. Uitgemolken zelfs. Het is niet perse slecht, maar wat verse inspiratie is nooit weg natuurlijk. Ik kreeg afgelopen week de code voor Kirby´s Dream Land 3 voor de Virtual Console op de Wii U opgestuurd en godzijdank ben ik niet lactose intolerant.
[You must be registered and logged in to see this link.] Een beetje gamer kent Kirby natuurlijk allang. Het roze, bolle ventje van Nintendo met meer zuigkracht dan een Nilfisk. Kirby kreeg zijn eerste eigen game in 1992 al op de Game Boy. Dit was Kirby’s Dream Land en het werd een regelrechte hit op de handheld van Nintendo. De game verkocht dusdanig goed dat deze op de vierde plaats staat op het lijstje met de meestverkochte Game Boy games. Geen geringe prestatie dus. De game werd nog dunnetjes overgedaan voor de NES onder de titel Kirby’s Adventure en ook dit werd een hit. Kirby was hot en de ene na de andere game werd uitgebracht door Nintendo. Kirby’s Dream Land 2 verscheen dan ook in 1995 voor de SNES en amper twee jaar later kwam op dezelfde console het derde deel in de Dream Land serie uit. Onlangs verscheen deze ook voor de Virtual Console op de Wii U.

Beter goed gejat..
Zwitserse horloges ..dan slecht bedacht. Nou gaat dat natuurlijk niet helemaal op voor deze titel, aangezien ontwikkelaar HAL Laboratory ook verantwoordelijk was voor het eerste deel en dus eigenlijk het hele concept al heeft bedacht, maar je kan iedere willekeurige review over een platformer van Kirby nalezen en je weet precies wat je mag verwachten van deze titel. Ik heb echt een hekel aan clichés, maar deze moet gewoon echt even: Kirby’s Dream Land 3 is echt niets nieuws onder de zon. Als je dus al één van de vele Kirby platformers in huis hebt liggen (of in je digitale kast ergens..), dan kun je deze review gewoon overslaan en je centen besparen voor een andere leuke titel als Earthbound . Ben je echt zo wereldvreemd dat je nog nooit een Kirby game hebt aangeraakt, dan is Kirby’s Dream Land 3 een prima titel voor je ontgroening. Over het verhaal ga ik overigens niet eens uitweiden, want dat is flinterdun en niet boeiend. Iets met King Dedede en “dark matter”…
Zwitserse horloges
nep-horloges Mijn excuses voor mijn hatelijk betoog tegenover onze roze vrind. Want hoewel we het allemaal al tig keer gezien hebben, is het wel weer een degelijke platformer geworden. Net als in Kirby’s Dream Land 2 zijn onze dierenvriendjes ook weer terug (zes in totaal) en kun je delen van de levels doorlopen op bijvoorbeeld de rug van hamster of gedragen worden door een boos kijkende vogel. Vergelijk het een beetje met Yoshi uit de Mario games, maar dan zonder eieren en met andere vaardigheden. Logischerwijs kun je met de vogel vliegen en heb je ook nog een enorme kat die Kirby door het leven heen rolt. Aan snelheid lever je dan wel weer het één en ander in, maar daar staat tegenover dat je dus wat meer vaardigheden hebt. Deze dierenvriendjes geven je ook een extra “oompf” als je een vijand inslikt en naar onder drukt op je D-pad. Kirby-spelers weten dat je met het opzuigen van een vijand en het doorslikken daarvan je de aanvallen van die vijand kunt kopiëren. Dit is echter niet bij iedere vijand het geval.
Naast deze zes dierenvriendjes, is daar ook nog een stuk slijm in de vorm van Gooey. Gooey is een heuse sidekick en loopt op zichzelf met jou het level door en helpt je bij het neermaaien van je tegenstanders en het verzamelen van goodies en items. Leuke bijkomstigheid is dat Gooey ook door een andere speler gespeeld kan worden en je dus coöperatief kunt spelen. Komt echter wel bij kijken dat de besturing van Gooey lang niet zo lekker loopt als die van Kirby en de mogelijkheden om eigenschappen van je tegenstanders te kopieëren nogal beperkt is.
Beter laat dan nooit
Kirby’s Dream Land 3 verscheen in november 1997 voor de SNES en was daarmee al erg laat, aangezien in maart van datzelfde jaar de Nintendo 64 al verscheen in Europa. Wellicht is dat ook de reden dat Kirby’s Dream Land 3 nooit het levenslicht in Europa heeft gezien voor wat betreft de SNES. Pas twaalf jaar later kon men in Europa voor het eerst aan de slag met deze game op de Virtual Console voor de Wii in 2009. Inmiddels zijn we weer vier jaar verder en is het de game inmiddels al wettelijk toegestaan om bier te drinken en zijn bromfietscertificaat te halen. Ik snap persoonlijk niet zo heel goed waarom nou juist deze game richting de Virtual Console op de Wii U komt, terwijl er nog zoveel andere toffe titels zijn die men kan uitbrengen.
Kan ik Kirby’s Dream Land 3 aanraden? Dat ligt eraan. Het is een prima platformer en de Kirby games stellen zelden teleur. Toch zijn er veel betere Kirby games verschenen. Nee, bespaar je lekker de centen en ga voor een andere toffe Virtual Console game. Als je dan toch persé een Kirby game wilt spelen omdat hij zo schattig en puffy is, dan raad ik je aan om voor de NES-klassieker Kirby’s Adventure te gaan. Eigenlijk exact dezelfde game, maar iets anders vormgegeven en iets lelijker aangezien het een 8-bit game is inplaats van 16-bit. Neemt niet weg dat Kirby’s Dream Land 3 volgepropt zit met schattige poppetjes, lieve dierenvriendjes en die vervelende appelboom. Wat is dat overigens met HAL Laboratory en die appelboom? Moet dat echt in iedere Kirby game? Zucht..

Project ‘Oogspanning’ in parochiezaal lokt jong en oud

Kurt Sesselle (45) is zelfstandig ondernemer, Wim Dhaese (39) mechanieker, Pieter De Maertelaere (23) biomedisch technicus. Twee zaken heeft het trio gemeen: alledrie zijn ze geworteld in de Oosteeklose klei en alledrie hebben ze een passie voor fotografie die ze nu een jaar lang loslaten op hun dorpsgenoten. ‘ Oogspanning ontstond doordat we iets unieks wilden brengen in ons kleine mooie dorp’, klinkt het. ‘Waar konden we dit beter doen dan op het dorpsplein?’ Na een jaar voorbereiding gingen de mannen van Oogspanning van start met hun avontuur. Vrijwel spontaan nadat de drie hun artistieke plannen ontvouwden, bood de vzw parochiale werken hun de etalage van het parochiecentrum aan. De rest is geschiedenis... Terwijl Oogspanning eerder al het afscheid van het Achterkwartier en ook het carnaval in Oosteeklo in de kijker plaatste, hangen er momenteel een serie ‘nachtwerk’-beelden van Pieter in de vitrine. Begin augustus komt er een opnieuw een ander verhaal. ‘Het klikt’ ‘Beeldmatig zullen we niet enkel vanuit Oosteeklo werken, al proberen we wel de link naar ons dorp te leggen. We zijn alledrie verschillende fotografen, wat de zaak nog aantrekkelijker maakt. Zo kunnen we elkaar aanvullen zonder elkaar te kopiëren. Eén ding is zeker: het klikt op een vreemde aanvullende manier.’ Oogspanning palmt niet alleen een etalage op het dorpsplein in, maar heeft ook een website. ‘We willen mensen op die manier prikkelen om naar de afdrukken te gaan kijken, hun gat op te lichten van die luie virtuele stoel waar alles zo makkelijk bereikbaar is. We willen beeld meer naar de mensen brengen, want hoe makkelijk dump je geen reeks beelden op het internet?’ De permanente collectie in de parochiezaal was initieel bedoeld voor één jaar, maar de kans dat het langer wordt is nu al heel reëel. ‘We hadden onszelf voorgenomen dat er interesse moest zijn, anders had het geen zin. Maar de reacties zijn buiten verwachting. We worden regelmatig aangesproken op straat. Het is prachtig om te zien hoe soms een peetje en meetje met de netzak aan de fiets op de terugweg van de bakker even halt houden bij onze etalage. Of hoe een jonge snaak met skateboard onder de arm voor de vitrine staat te kijken. De max toch?’

[You must be registered and logged in to see this link.] OOSTEEKLO - Onder de noemer ‘Oogspanning’ geven drie fotografen in de etalage van de parochiezaal van Oosteeklo een jaar lang hun eigenzinnige kijk op het leven.
Kurt Sesselle (45) is zelfstandig ondernemer, Wim Dhaese (39) mechanieker, Pieter De Maertelaere (23) biomedisch technicus. Twee zaken heeft het trio gemeen: alledrie zijn ze geworteld in de Oosteeklose klei en alledrie hebben ze een passie voor fotografie die ze nu een jaar lang loslaten op hun dorpsgenoten. ‘ Oogspanning ontstond doordat we iets unieks wilden brengen in ons kleine mooie dorp’, klinkt het. ‘Waar konden we dit beter doen dan op het dorpsplein?’ Na een jaar voorbereiding gingen de mannen van Oogspanning van start met hun avontuur. Vrijwel spontaan nadat de drie hun artistieke plannen ontvouwden, bood de vzw parochiale werken hun de etalage van het parochiecentrum aan. De rest is geschiedenis... Terwijl Oogspanning eerder al het afscheid van het Achterkwartier en ook het carnaval in Oosteeklo in de kijker plaatste, hangen er momenteel een serie ‘nachtwerk’-beelden van Pieter in de vitrine. Begin augustus komt er een opnieuw een ander verhaal. ‘Het klikt’ ‘Beeldmatig zullen we niet enkel vanuit Oosteeklo werken, al proberen we wel de link naar ons dorp te leggen. We zijn alledrie verschillende fotografen, wat de zaak nog aantrekkelijker maakt. Zo kunnen we elkaar aanvullen zonder elkaar te kopiëren. Eén ding is zeker: het klikt op een vreemde aanvullende manier.’ Oogspanning palmt niet alleen een etalage op het dorpsplein in, maar heeft ook een website. ‘We willen mensen op die manier prikkelen om naar de afdrukken te gaan kijken, hun gat op te lichten van die luie virtuele stoel waar alles zo makkelijk bereikbaar is. We willen beeld meer naar de mensen brengen, want hoe makkelijk dump je geen reeks beelden op het internet?’ De permanente collectie in de parochiezaal was initieel bedoeld voor één jaar, maar de kans dat het langer wordt is nu al heel reëel. ‘We hadden onszelf voorgenomen dat er interesse moest zijn, anders had het geen zin. Maar de reacties zijn buiten verwachting. We worden regelmatig aangesproken op straat. Het is prachtig om te zien hoe soms een peetje en meetje met de netzak aan de fiets op de terugweg van de bakker even halt houden bij onze etalage. Of hoe een jonge snaak met skateboard onder de arm voor de vitrine staat te kijken. De max toch?’

Wiggins finished alongside fellow Team Sky rider Ben Swift and Giro winner Vincent Nibali nine minutes and 13 seconds behind Ulussi, who held off Darwin Atapuma and Rafal Majka in a sprint finish.

Gross sales at Swatch increased a slightly better-than-expected 8.7 percent to 4.181 billion francs ($4.47 billion) in the first half of the year, significantly less than the 14.4 percent growth seen in the year-ago period.
"The U.S. market is doing very well, the UK is improving and tourist shopping is supporting Italy," Hayek said. "France is giving us a bit of a headache, without the tourists, there would be hardly any consumption there."
He said the group might be able to achieve 9 billion Swiss francs in gross sales this year if the dollar rose a bit and if the group could build enough stock to satisfy high demand for jewellery made by the newly acquired Harry Winston brand.
It is currently Swatch Group's priority to put production back on track at Canadian jeweler Harry Winston, which it bought for almost $1 billion this year, Hayek said.
NECKLACES AND RINGS
"We need a lot of high-end products at Harry Winston so we can satisfy all these customers walking, for example, into our store on (New York's) 5th Avenue to buy necklaces and rings in the range of more than $10 million. So you can imagine that it is crucial that enough products are available in the store."
Hayek said stocks at the brand were quite low now but he wanted to increase them to about $800 million to ensure he had $30-40 million in stock at each of the brand's 23 stores.
Hayek said the group's operating margin could bounce back to 24-25 percent in the second half after dropping to 22.7 percent in the first, hit by high expenses for the Basel watch fair and investment into new products, such as its mechanical Swatch watch Sistem51 and an antimagnetic Omega.
"I gave the green light to spend an additional 40 million francs on marketing in June just to promote our new products at Swatch, Omega and Longines. ... I don't care if that hit our margin in the short term, it's the long term that counts."
Shares in Swatch were up 3.1 percent by 1132 GMT, outperforming a flat sector index , after falling some 12 percent from May's all-time high as markets were pricing in a forthcoming weak first half. Luxury goods group Richemont , which also hit a peak in May, has shed only 5 percent.
They trade at about 15.1 times forward earnings, according to Reuters data, at a discount to Richemont at 16.8 times and LVMH at 16.7 times.
Citi analyst Thomas Chauvet said the expectations for a rebound in demand and margins in the second half were already largely priced in and he expected consensus to come down.
Net profit was up 6.1 percent to 768 million francs, ahead of a 728 million estimate in a Reuters poll, with analysts citing a better-than-expected financial result and a lower tax rate.

Holts is not alone in the fight for big spenders. From Harry Rosen Inc. to La Maison Simons , premium fashion retailers are feeling the heat. The Americans are coming, and they know it.The market in Canada will become decidedly more crowded. This week, Hudson’s Bay Co. unveiled a $2.4-billion deal to buy New York-based Saks Inc. and bring as many as seven of its tony Saks Fifth Avenue outlets to Canada. Seattle-based Nordstrom Inc. will open its first Canadian store in the fall of 2014 and has plans for up to 10 locations. Luxury brands that supply the chains, from Hugo Boss to Stuart Weitzman, are opening their own standalone boutiques, raising the ante for incumbents.Erik Nordstrom, president of stores at the chain that bears his name, isn’t daunted. He said in an interview this week that when staking out new territory, “traditionally we look for the best competition, because that’s where the most business is to be had.“Once we get those locations, we have to compete like crazy ... Sometimes there is fallout.”High-end fashion merchants are preparing for an unprecedented level of competition, not only in their bricks-and-mortar stores but also in the fast-growing e-commerce segment. To succeed, they will need to freshen their stores, making it easier and faster for shoppers to find products and check out with mobile devices. They will need to better understand their customers’ demands to tailor offerings to them, while focusing increasingly on cybershoppers. And while demand for $800 Coach handbags and $295 J. Brand skinny jeans is growing among Generation Y consumers, there is evidence that, over all, wealthy customers aren’t opening their wallets much wider than they did in previous years.“The suggestion is that there is an undeveloped market in Canada – there is a need,” said Alecsandra Hancas, fashion industry analyst at market researcher NPD Group. “But we’re not seeing a lot of money spent in the luxury market.”The changes will force incumbents to improve their store ambiance, customer service and product selection. Consumers will potentially benefit from better service and even possibly lower prices. Calling big spenders The luxury players who are preparing for battle are expecting to serve a swelling population of heavy spenders in this country.While data on the Canadian luxury fashion market is in short supply and inconsistent, research does point to a growing number of wealthy consumers. The number of households with income of more than $200,000 accelerated four times as fast as that of households with average incomes since 2007, according to Environics Analytics. And the number of households in the top income bracket – over $250,000 – jumped 34.2 per cent since 2008, with 14.9-per-cent growth in the past year alone, it said.But growth in the $83.4-billion North American luxury market over all isn’t exactly robust. According to consultancy Bain & Co., the segment is expected to grow by just 5 to 7 per cent this year, less than half the 13 per cent it grew last year.The Canadian market could see an uptick as consumers who would ordinarily travel across the border to visit U.S. retailers can now shop at home. Cross-border shopping has taken away an estimated $1-billion in business from Canadian retailers in the year to May, according to NPD’s Ms. Hancas. Its research shows consumers are spending more on apparel purchases outside Canada, suggesting that they’re purchasing more expensive items, such as those found at retailers such as Nordstrom and Saks.While there may be some room for new competitors, there is still significant pressure on domestic retailers, who can ill afford to lose sales to newcomers. “There has to be a bit of a shakeout,” said Larry Rosen, chief executive officer of Harry Rosen. “It’s got to come from somewhere.”One of the key issues will be how to stand out from the pack.Both Holts and Harry Rosen have embarked on expensive makeovers – in the latter case, the company is spending $100-million over the next several years to revamp and expand stores by 40 per cent. Privately held Harry Rosen has enjoyed annual post-recession sales gains of about 10 per cent, although they slowed to 3 per cent in the first half of this year amid dipping consumer confidence, Mr. Rosen said.But differentiation is challenging when the retailers carry lots of the same brands and cater to many of the same well-off customers, said Antony Karabus, president of Hilco Retail Consulting in Chicago, who has advised major luxury retailers. Holts and Saks in particular have significant overlap, with labels ranging from Chanel to Prada to Diane von Furstenberg.Nordstrom has a broader array of goods, but an estimated one-third of its most expensive lines are also stocked at Saks and perhaps as much as half of its brands overlap with those at Hudson’s Bay, catering to customers who are looking for more affordable luxury. Mr. Nordstrom, the great-grandson of the chain’s founder, acknowledged that there be will some overlap but said “we don’t get too consumed with any competitors. In this specific case, I don’t think it really changes the landscape.”“We have a broader offering,” he said. “We compete with Hudson’s Bay on one end and we compete with Holts and now, presumably, Saks at the upper end, which is no different than what we have here in the U.S.”Nordstrom prides itself on customer service, famously giving staff leeway to go out of their way to help shoppers. Recently, a Vancouver resident wrote online about her friend having her purse stolen at Nordstrom’s flagship store in Seattle while she was trying on a pair of boots.The manager took the woman and her friend to the store restaurant, to wait for police, where he bought them meals, drinks and chocolates, handed them a bottle of champagne and gave the woman $400 to buy a new purse.“If we can deliver the best Nordstrom experience up there, I think we’ll be successful regardless of what goes on outside our control,” Mr. Nordstrom said. The ‘Harrods of Canada’ The ground may shift more quickly than either Nordstrom or Holts expect, as HBC closes its deal to buy Saks by the end of this year.Richard Baker, the U.S. real-estate-magnate-turned-retail-mogul who acquired the struggling HBC in 2008, promises to move quickly. Sources familiar with HBC said he expects to open the first two Saks stores within the Toronto and Vancouver flagship stores by the end of 2014.Mr. Baker is modelling the future Hudson’s Bay on its Toronto Queen Street West store , with a huge new shoe department, and in-store shops including Topshop from Britain, Kleinfeld Bridal Boutique from New York and, according to plans, Saks in 2014.“It will become the Harrods of Canada,” Mr. Baker said in an interview Friday, referring to the prestigious London-based department store. “Bringing Saks to Canada is going to keep Canadians shopping in Canadian dollars in Canada.”He predicted that HBC will have an edge over Nordstrom, as it already has stores, systems, technology and Canadian know-how in place to roll out Saks quickly.Nordstrom is spending more than it had originally forecast for technology and merchandising systems for its Canadian stores, Mr. Nordstrom said in the interview. The investment is partly for mobile checkouts, which the company has in its U.S. outlets.“We haven’t operated our stores in another country before,” he said. “Almost every single business operational process needs to be different in some way. That’s been a lot of work for us.”Saks has an edge when it comes to selling pricey brands, whether it’s $4,000 Gucci leather jackets or $3,500 Jimmy Choo clutch purses, as it can count on economies of scale to lower costs and boost the bottom line. The increased number of competitors creates an issue for suppliers, however, which must figure out how to divvy up their collections without compromising past allegiances, or cannibalizing their current sales.The new entrants could force everyone to lower prices, squeezing margins for vendors and retailers, even as it’s a boon for consumers, said Joey Adler, chief executive officer of Diesel Canada, whose various lines are now carried in all the chains (although differentiated by style and price) as well as three standalone Diesel stores.While pleased to have a greater number of potential customers, Ms. Adler said that suppliers “are worried about having another retailer on board and being able to serve it properly and have them be successful.”Shoe company Stuart Weitzman, whose lines are stocked at Saks, Holts and Nordstrom, faces a similar dilemma.“It’s really the evolution of retail,” said Nicholas Niro, director of the Stuart Weitzman Canadian operation. “As fresh brands come in, more tired brands will come out. That’s what will happen in the next five to 10 years.”Developers are seeing opportunity, as they woo upscale new entrants. Yorkdale has been among the most successful, now generating more than $1,300 of sales per square foot.West Edmonton Mall, the country’s largest shopping centre, is rapidly adding more luxury banners, such as jewellery specialist Tiffany & Co., with the centre’s sales now at about $745 a square foot, up from $450 five years ago and aimed at $1,000 in the next few years, mall president David Ghermezian said. La Maison Simons rolled out its first store outside of Quebec last fall at West Edmonton and its performance “has exceeded all our expectations.”Mr. Ghermezian is pitching for Nordstrom, among others, to come to his mall and will soon speak to Mr. Baker about Saks. “Eventually, there will be a saturation point but I don’t think we’re there yet,” he said. “At some point, it will be too much.” ‘Some fallout’ The retailer with perhaps the most to lose is Holt Renfrew, by virtue of its position as the dominant luxury player. “Holts, I suspect, will lose some business,” consultant Mr. Karabus said. “I think there will be some fallout.”Owned by the Weston family, which also owns Selfridges in Britain, other prominent overseas chains, and controls grocery giant Loblaw Cos. Ltd., Holts is not standing still.The company is using its Yorkdale store, which will relaunch by the fall, as a laboratory. Set to double in size, it will feature a beefed-up men’s section and a new men’s lounge, a grooming area to get a shave and “tech toys” to keep men in the store and in the buying mood, Alix Box, vice-president of marketing at Holts, said late last year. (The company did not provide an executive for an interview this week.) The store will spotlight designer brands including heavyweights Manolo Blahnik, Jimmy Choo, Donna Karan, all of which are stocked at Saks.Fitting rooms will be up to three times larger than current ones – “Big enough so that a woman could bring five or six of her best friends and shop together, which is a growing habit we’ve seen among our high-value clients,” she said. With nine stores, Holts has also announced it will launch a new store in Mississauga’s Square One Shopping Centre and expand its space by 40 per cent over all.“Holts is aggressively expanding – don’t underestimate it,” consultant Mr. Karabus said. “The Westons are extraordinary retailers.”But if there’s an Achilles heel, it’s in online sales. Its importance can’t be underestimated: Total Internet luxury spending is expected to nearly double to $12.5-billion by 2015, says American Express. Holts has yet to launch a cyber-shop.Harry Rosen, which has annual sales of about $300-million, saw its e-commerce sales soar 90 per cent in the first six months of 2013 (though it makes up about 2 per cent of total sales). And both Saks and Nordstrom have reported that growth in their e-commerce businesses has outpaced those in their conventional stores.Stephen Sadove, chief executive officer at Saks, said customers who shop both online and in-store purchase about three or four times as much as those who shop in a single channel. “Getting people to shop both channels is extremely important,” he told Saks’ annual meeting in June.

Privately held Harry Rosen has enjoyed annual post-recession sales gains of about 10 per cent, although they slowed to 3 per cent in the first half of this year amid dipping consumer confidence, Mr. Rosen said.But differentiation is challenging when the retailers carry lots of the same brands and cater to many of the same well-off customers, said Antony Karabus, president of Hilco Retail Consulting in Chicago, who has advised major luxury retailers. Holts and Saks in particular have significant overlap, with labels ranging from Chanel to Prada to Diane von Furstenberg.Nordstrom has a broader array of goods, but an estimated one-third of its most expensive lines are also stocked at Saks and perhaps as much as half of its brands overlap with those at Hudson’s Bay, catering to customers who are looking for more affordable luxury. Mr. Nordstrom, the great-grandson of the chain’s founder, acknowledged that there be will some overlap but said “we don’t get too consumed with any competitors. In this specific case, I don’t think it really changes the landscape.”“We have a broader offering,” he said. “We compete with Hudson’s Bay on one end and we compete with Holts and now, presumably, Saks at the upper end, which is no different than what we have here in the U.S.”Nordstrom prides itself on customer service, famously giving staff leeway to go out of their way to help shoppers. Recently, a Vancouver resident wrote online about her friend having her purse stolen at Nordstrom’s flagship store in Seattle while she was trying on a pair of boots.The manager took the woman and her friend to the store restaurant, to wait for police, where he bought them meals, drinks and chocolates, handed them a bottle of champagne and gave the woman $400 to buy a new purse.“If we can deliver the best Nordstrom experience up there, I think we’ll be successful regardless of what goes on outside our control,” Mr. Nordstrom said. The ‘Harrods of Canada’ The ground may shift more quickly than either Nordstrom or Holts expect, as HBC closes its deal to buy Saks by the end of this year.Richard Baker, the U.S. real-estate-magnate-turned-retail-mogul who acquired the struggling HBC in 2008, promises to move quickly. Sources familiar with HBC said he expects to open the first two Saks stores within the Toronto and Vancouver flagship stores by the end of 2014.Mr. Baker is modelling the future Hudson’s Bay on its Toronto Queen Street West store , with a huge new shoe department, and in-store shops including Topshop from Britain, Kleinfeld Bridal Boutique from New York and, according to plans, Saks in 2014.“It will become the Harrods of Canada,” Mr. Baker said in an interview Friday, referring to the prestigious London-based department store. “Bringing Saks to Canada is going to keep Canadians shopping in Canadian dollars in Canada.”He predicted that HBC will have an edge over Nordstrom, as it already has stores, systems, technology and Canadian know-how in place to roll out Saks quickly.Nordstrom is spending more than it had originally forecast for technology and merchandising systems for its Canadian stores, Mr. Nordstrom said in the interview. The investment is partly for mobile checkouts, which the company has in its U.S. outlets.“We haven’t operated our stores in another country before,” he said. “Almost every single business operational process needs to be different in some way. That’s been a lot of work for us.”Saks has an edge when it comes to selling pricey brands, whether it’s $4,000 Gucci leather jackets or $3,500 Jimmy Choo clutch purses, as it can count on economies of scale to lower costs and boost the bottom line. The increased number of competitors creates an issue for suppliers, however, which must figure out how to divvy up their collections without compromising past allegiances, or cannibalizing their current sales.The new entrants could force everyone to lower prices, squeezing margins for vendors and retailers, even as it’s a boon for consumers, said Joey Adler, chief executive officer of Diesel Canada, whose various lines are now carried in all the chains (although differentiated by style and price) as well as three standalone Diesel stores.While pleased to have a greater number of potential customers, Ms. Adler said that suppliers “are worried about having another retailer on board and being able to serve it properly and have them be successful.”Shoe company Stuart Weitzman, whose lines are stocked at Saks, Holts and Nordstrom, faces a similar dilemma.“It’s really the evolution of retail,” said Nicholas Niro, director of the Stuart Weitzman Canadian operation. “As fresh brands come in, more tired brands will come out. That’s what will happen in the next five to 10 years.”Developers are seeing opportunity, as they woo upscale new entrants. Yorkdale has been among the most successful, now generating more than $1,300 of sales per square foot.West Edmonton Mall, the country’s largest shopping centre, is rapidly adding more luxury banners, such as jewellery specialist Tiffany & Co., with the centre’s sales now at about $745 a square foot, up from $450 five years ago and aimed at $1,000 in the next few years, mall president David Ghermezian said. La Maison Simons rolled out its first store outside of Quebec last fall at West Edmonton and its performance “has exceeded all our expectations.”Mr. Ghermezian is pitching for Nordstrom, among others, to come to his mall and will soon speak to Mr. Baker about Saks. “Eventually, there will be a saturation point but I don’t think we’re there yet,” he said. “At some point, it will be too much.” ‘Some fallout’ The retailer with perhaps the most to lose is Holt Renfrew, by virtue of its position as the dominant luxury player. “Holts, I suspect, will lose some business,” consultant Mr. Karabus said. “I think there will be some fallout.”Owned by the Weston family, which also owns Selfridges in Britain, other prominent overseas chains, and controls grocery giant Loblaw Cos. Ltd., Holts is not standing still.The company is using its Yorkdale store, which will relaunch by the fall, as a laboratory. Set to double in size, it will feature a beefed-up men’s section and a new men’s lounge, a grooming area to get a shave and “tech toys” to keep men in the store and in the buying mood, Alix Box, vice-president of marketing at Holts, said late last year. (The company did not provide an executive for an interview this week.) The store will spotlight designer brands including heavyweights Manolo Blahnik, Jimmy Choo, Donna Karan, all of which are stocked at Saks.Fitting rooms will be up to three times larger than current ones – “Big enough so that a woman could bring five or six of her best friends and shop together, which is a growing habit we’ve seen among our high-value clients,” she said. With nine stores, Holts has also announced it will launch a new store in Mississauga’s Square One Shopping Centre and expand its space by 40 per cent over all.“Holts is aggressively expanding – don’t underestimate it,” consultant Mr. Karabus said. “The Westons are extraordinary retailers.”But if there’s an Achilles heel, it’s in online sales. Its importance can’t be underestimated: Total Internet luxury spending is expected to nearly double to $12.5-billion by 2015, says American Express. Holts has yet to launch a cyber-shop.Harry Rosen, which has annual sales of about $300-million, saw its e-commerce sales soar 90 per cent in the first six months of 2013 (though it makes up about 2 per cent of total sales). And both Saks and Nordstrom have reported that growth in their e-commerce businesses has outpaced those in their conventional stores.Stephen Sadove, chief executive officer at Saks, said customers who shop both online and in-store purchase about three or four times as much as those who shop in a single channel. “Getting people to shop both channels is extremely important,” he told Saks’ annual meeting in June.

Question: What are the provisions of 17 U.S.C. Section 512(c)(3) & 512(d)(3)?
Answer: Section 512(c)(3) sets out the elements for notification under the DMCA. Subsection A (17 U.S.C. 512(c)(3)(A)) states that to be effective a notification must include: 1) a physical/electronic signature of a person authorized to act on behalf of the owner of the infringed right; 2) identification of the copyrighted works claimed to have been infringed; 3) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed; 4) information reasonably sufficient to permit the service provider to contact the complaining party (e.g., the address, telephone number, or email address); 5) a statement that the complaining party has a good faith belief that use of the material is not authorized by the copyright owner; and 6) a statement that information in the complaint is accurate and that the complaining party is authorized to act on behalf of the copyright owner. Subsection B (17 U.S.C. 512(c)(3)(B)) states that if the complaining party does not substantially comply with these requirements the notice will not serve as actual notice for the purpose of Section 512.Section 512(d)(3), which applies to "information location tools" such as search engines and directories, incorporates the above requirements; however, instead of the identification of the allegedly infringing material, the notification must identify the reference or link to the material claimed to be infringing.
Question: Does a service provider have to follow the safe harbor procedures?
Answer: No. An ISP may choose not to follow the DMCA takedown process, and do without the safe harbor. If it would not be liable under pre-DMCA copyright law (for example, because it is not contributorily or vicariously liable, or because there is no underlying ....), it can still raise those same defenses if it is sued.
Question: How do I file a DMCA counter-notice?
